There are different limits for how many demerit points you can accumulate before you risk having your licence suspended.

This depends on what sort of licence you are on:. If you do not reply to VicRoads within 21 days, they will suspend your licence. The date that the suspension starts is written on the demerit point option notice. The VicRoads website has more information about what to do if you are issued with a demerit point option notice.

If you lose your licence you must not drive at all during this time. There are no exceptions. For example, you cannot drive to work or to pick up your children. There are very serious penalties for driving while suspended. If your licence is suspended for exceeding demerit points and also for some other offence, both suspensions can be served at the same time. Demerit points are counted from the date that the offence allegedly happened, even if they are not recorded by VicRoads until later.

If you have successfully completed the month period without getting any more points, all demerit points on your licence when the option notice was issued will be removed. Any demerit points you got after this will remain on your licence. If you get too many demerit points and also have your licence suspended for another offence, VicRoads will suspend your licence for having too many demerit points.

If you are caught breaking the law for some offences, you will be issued with a penalty in the form of an infringement notice a fine. Depending on the offence, demerit points or licence suspension may also be applied to your driver's licence. A demerit point is a penalty point issued to you if you commit a driving related offence that has associated demerit points. These points are recorded against your driving record. Demerit points range from 1 to 10 depending on the seriousness of the offence.

They accumulate and remain valid for 3 years. To check how many demerit points are recorded on your licence, see Check driver history on the VicRoads website. Companies are directed to nominate the driver responsible for any operator onus offences such as speeding, red light and level crossing offences committed in a company vehicle. Visit the VicRoads website for more information on demerit points.

When an Infringement Notice is issued by an enforcement agency, you must pay it by the due date or do something about it. If you do not pay it or do something about it, a Penalty Reminder Notice is issued for the fine.
